Yet another fatal accident has occurred in Liberty County after a Midway resident loses his life in an auto accident on Highway 84. Just before the Christmas holidays, John McGrath, now deceased, was heading east on 84 in his suv when another driver, Shania Simmons, 17, turned in front of his vehicle therein causing the accident. McGrath’s suv violently slammed into Simmons’ Honda on the driver’s side door. When authorities arrived on the scene they found McGrath dead in his vehicle. Simmons was taken via EMS to a local hospital for her injuries.
Unfortunate accidents such as the one discussed here are never expected or even contemplated until it is too late. Nonetheless it is important for the family of McGrath to realize they have legal rights on his behalf to seek a civil judgment against the negligent driver causing the accident. In reality there is no real reason that such a suit should not be pursued in his honor and memory.
