Ten people were injured after an elderly man slammed his SUV into a crowd of people at an outdoor market Thursday in Rochester, New York. Authorities say the 89 year-old man’s foot slipped off the brake and hit the accelerator causing his vehicle to strike innocent bystanders. Although only two were seriously injured the other eight individuals may have a claim for their less serious but nonetheless painful injuries as well. If the more seriously injured victims exhaust the 89 year-old’s insurance coverage, the other eight victims may be able to use their underinsured motorist coverage for their medical expenses even though they were not in their individual vehicles at the time of the accident.
